The privacy of the Users is particularly important to MOLL TELECOM SERVICE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (a limited liability company). Therefore, we guarantee to the www.moll.com.pl Website’s Users the highest standards of privacy protection. MOLL TELECOM SERVICE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (a limited liability company) as the personal data Controller takes care of the security of the data made available by the Users. The Controller also ensures that the Users are properly informed about the rights and obligations relating to the personal data processing, in particular, in accordance with the provisions on personal data protection under the Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of data protection and on the free movement of such data, and repealing Directive 95/46/EC (‘GDPR’). To ensure the Website User’s privacy, in this document, the Controller sets out the legal grounds for the processing of personal data provided by the Users with regard to their use of the www.moll.com.pl Website (‘Website’), the means of the personal data is collected, processed and protected, as well as the Users’ rights.

A User is any natural person who is a data subject using the www.moll.com.pl Internet Website or the electronic services made available through the Website.

  1. USER’S CONSENT 

    By using the www.moll.com.pl Website, the User consents to the collection and use of personal data by the Controller in compliance with this Privacy Policy.

    The personal data of the Website’s User is processed by the Controller based on the User’s consent and, in certain cases stipulated in this document, on the grounds of legitimate interest of the Controller. The User has the right to withdraw his or her consent at any time. The withdrawal of consent will not affect the lawfulness of processing based on the consent before its withdrawal.

    Where this Privacy Policy is changed and the User continues to use the Website, it is deemed that the User agrees to the updated Privacy Policy terms.

     

  2. PERSONAL DATA PROCESSED BY THE CONTROLLER
    1. The means of obtaining the personal data

      The Controller obtains the personal data directly from the User via the Website when the User fills out the contact form available on the Website and sends a message to the Controller via the Website.

      The personal data to be provided in the contact form is given freely.

    2. The types of personal data subject to processing

      When using the Website, the following data of the User is collected by the Controller:

      1. First and last name;
      2. E-mail address;
      3. Phone number;
      4. Content of the message;
      5. Subject of the message;
      6. Business name.

     

  3. PURPOSES OF THE PERSONAL DATA PROCESSING

    The means of the User’s personal data processing by the Controller depend on the way the User is using the Website and available functionalities. The Controller processes the User’s personal data for the following purposes:

    1. Communication with the User.

      The Controller uses the User’s personal data for the purposes of personalized communication with the User. The information communicated to the User relates to the products and services offered, personal data security, network updates, reminders, and also suggested offers of the Controller or its partners. The User communication also relates to the User’s customer service. Consequently, the personal data is used in order to assist the User, resolve technical problems and respond to the User’s complaints.

    The Controller may also process the User’s personal data submitted through the contact form for the purpose of:

    1. concluding and performing a possible contract between the User and the Collector and rendering the services to the User as the Controller’s client in accordance with Article 6(1)(b) GDPR;
    2. financial settlements with the User being the Controller’s client for the performance of possible contract concluded between the parties, and also of exercising any claims from the User being the client within the legitimate interest of the Controller in accordance with Article 6(1)(f) GDPR and performing legal obligations of the Controller towards tax authorities under separate regulations in accordance with Article 6(1)(c) GDPR;
    3. conducting the Controller’s marketing activities within the legitimate interest of the Controller as defined in Article 6(1)(f) GDPR, as well as with the statements relating to marketing communication made by the Controller. The consents relating to marketing communication (e.g. to sending commercial information by electronic means or phone contact for the purpose of direct marketing) may be withdrawn at any time, without affecting the lawfulness of processing based on the consent before its withdrawal;
    4. performing the legal obligations of the Controller towards the User as defined in Article 6(1)(c) GDPR.

     

  4. MAKING THE PERSONAL DATA AVAILABLE

    The Controller will not make the User’s personal data available to any third parties.

     

  5. THE USER’S RIGHTS 
    1. The User’s rights

      At any stage of the data processing, the User has various rights and powers with regard to the access to his or her personal data, verification of the personal data processing compliance, correction including the right to object to the processing of personal data, as well as the right to request the data erasure or restriction of processing or transfer.

    2. The right to lodge a complaint with a supervisory authority

      The User whose personal data is processed by the Controller has the right to lodge a complaint to a supervisory authority for personal data protection (the President of the Personal Data Protection Office).

       

  6. COOKIES FILES
    1. The Controller informs that when using the Website, short text information called ‘cookies’ is downloaded on the User’s end device. Cookies contain such data as: IP address of the User, name of the Internet site the files come from, the period of storage on the User’s device, the record of parameters and statistics, and a unique number. Cookie files are sent to the Website’s server via the Internet browser installed on the User’s device.

       

      Cookies are used on the Website to:
      1. maintain the technical correctness and session continuity between the Website’s server and the User’s device;
      2. optimize the User’s experience when visiting the Website’s pages and customized display on the User’s end device;
      3. ensure that the Website is safe to use;

      The Controller provides for relevant measures so as to ensure the security of the User’s personal data. The exploitation of the Website is secured by appropriate security systems and procedures to protect the data against access or release to unauthorized parties. Additionally, the systems and processes used by the Controller are monitored on an ongoing basis to detect any potential risks. The personal data obtained by the Controller is stored in the computer systems with a strictly limited access.

    2. Personal data storage

      The storage period of the User’s personal data is dependent on the purposes of data processing by the Controller. The Controller stores the personal data in the manner that is required for the fulfilment of specific purposes, i.e.:

      •  for the period the Controller is conducting its business activity.
        In any of the cases mentioned above, after the period that is necessary for the data processing, the data may be processed solely for the purposes of exercising the claims resulting from the relationship between the parties until the final resolution of the claims in a legal action.

    3. Changes to the Privacy Policy

      This Privacy Policy may be changed from time to time so as to keep the information updated and in compliance with the applicable regulations. When the Privacy Policy content is changed, the update date at the end of the document will be modified. To obtain information about the manner of personal data protection, the Controller recommends that the Users refer to the Privacy Policy on a regular basis.
